By accessing or using TwitchPicker, including the free trials and any paid plan, you agree to these Terms and Conditions. If you do not agree with any part of them, please do not use the service. If you are using TwitchPicker on behalf of a company or organization, you confirm that you have the authority to accept these terms on its behalf.
2. What TwitchPicker provides
TwitchPicker is a tool that collects public Twitch chat activity during a listen window you control and randomly selects winners for your giveaways and contests. We provide the software and the random selection process; you remain responsible for designing your giveaway, setting its rules, and fulfilling any prizes you promise. We do not run your giveaway for you and we are not a party to the contests you operate.
3. Eligibility and accounts
You must be old enough to form a binding contract in your jurisdiction to use TwitchPicker. If you create an account, you are responsible for keeping your login details secure and for all activity that happens under your account. Let us know promptly if you suspect any unauthorized use.
4. Free trials and paid plans
We offer three free trials so you can test the service. Paid plans, including the Creator and Growth options, unlock higher limits and additional features as described on our pricing page. Fees are billed in advance according to the plan you select. Unless stated otherwise, subscriptions may renew automatically, and you are responsible for canceling before a renewal if you do not wish to continue. Prices may change, and we will give reasonable notice of any change that affects you.
5. Acceptable use
You agree to use TwitchPicker lawfully and fairly. You must not use the service to run fraudulent or deceptive giveaways, to harvest data for purposes that violate the rights of others, to interfere with or overload our systems, to attempt to reverse engineer or resell the service, or to break any applicable law or third-party platform rules, including those of Twitch. We may suspend or terminate access for anyone who misuses the tool.
6. Your giveaways are your responsibility
You alone are responsible for ensuring your contests comply with the laws and platform policies that apply to them, including any rules about promotions, sweepstakes, taxes, eligibility, and disclosure. Many regions and platforms have specific requirements for running giveaways, and it is your job to meet them. TwitchPicker provides a fair selection mechanism, but the legality and conduct of your promotion rest with you.
7. Intellectual property
The TwitchPicker software, branding, and content are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service for its intended purpose while your account is in good standing. You may not copy, modify, distribute, or create derivative works from the service without our permission.
8. Third-party platforms
TwitchPicker relies on the Twitch platform and its API to function. We do not control Twitch, and changes on their side may affect how the tool works. We are not affiliated with, endorsed by, or sponsored by Twitch, and we are not responsible for the availability or behavior of any third-party service.
9. Disclaimers
The service is provided on an "as is" and "as available" basis. While we work hard to keep TwitchPicker accurate, fair, and reliable, we do not guarantee that it will always be uninterrupted, error-free, or suitable for every purpose. The random selection process is designed to be fair, but you use the results at your own discretion and risk.
10. Limitation of liability
To the fullest extent permitted by law, TwitchPicker and its team will not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including lost profits, lost goodwill, or disputes connected to a giveaway you ran. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.
11. Termination
You may stop using TwitchPicker at any time. We may suspend or end your access if you breach these terms or use the service in a way that harms us, other users, or third parties. On termination, the rights granted to you under these terms end, while sections that by their nature should survive, such as those on liability and intellectual property, continue to apply.
12. Changes to these terms
We may update these terms as the product and the law change. When we make material changes, we will revise the date above and, where appropriate, notify you. Continuing to use TwitchPicker after an update means you accept the new terms.
13. Governing law
These terms are governed by the laws of the jurisdiction in which TwitchPicker operates, without regard to conflict-of-law principles. Any disputes will be handled in the appropriate courts of that jurisdiction, unless the law gives you the right to bring a claim elsewhere.
